WHAT IS A SUCCESSION CERTIFICATE?

Succession means Taking over or Acquisition of property by descent or by Will. A Succession Certificate is a certificate which is issued by a district judge under Succession Act, 1925 to a person being Legal and Authorized heirs of all the inheritance left by deceased or died person. 

A deceased person left some legacy behind him which in turn transferred to its legal and Shariah heirs. It may be a property, vehicles, land, cash at hand or at bank and every thing including liabilities which will have to be paid off from assets left behind by deceased.

WHO ISSUES A SUCCESSION CERTIFICATE?

A succession certificate is issued by the District Judge or additional district judge of the area where they hold jurisdiction over it. or where the cause of action or deceased person ordinarily living at the time of his death or if no such place is available, the jurisdiction within which any property belonging to the deceased may be locating or existing.

No. Not in Pakistan but in India for some states you can get succession certificate through online portal 

WHAT ARE THE PROPERTIES FOR WHICH SUCCESSION CERTIFICATE CAN BE OBTAINED?

You can get succession certificate for all type of inheritance left by deceased/died person including but not limited to it:-

  • Prize bonds
  • Stock exchange Shares
  • Items lying in bank lockers
  • Insurance claims
  • Money kept in bank account
  • Stocks
  • Saving Certificates etc.

WHAT ARE THE DOCUMENTS REQUIRED TO OBTAIN A SUCCESSION CERTIFICATE?

Any Documents may be demanded by court as per the situation to clear doubts but following documents may be required but not limited to it:- 

  • 1.   Death certificate of deceased person
  • 2.   Statement of Account duly issued by bank reflecting name of deceased person
  • 3.   Copy of prize bonds, if any
  • 4.   Copy of Saving Certificates, if any
  • 5.   Copy of share certificate, if any
  • 6.   Proof of ownership of shares in Partnership business or company as the case may be, if any
  • 7.   Proof of other documents reflecting the entitlement or ownership of deceased person in relation to movable items detailed above.

WHAT IS THE PROCEDURE TO OBTAIN A SUCCESSION CERTIFICATE?

The legal procedure to obtain the succession certificate is detail as below:

  • 1: The applicant who wishes to obtain the Certificate of Succession must prepare a petition in prescribed form and manner, duly signed, certified and verified by the Commissioner of Oath, and present it to the District Judge who has jurisdiction to pursue the matter further. to meet the formal requirement.
  • 2: The district judge will proceed and resolve the matter in the same way as in a civil action and will set a date for the hearing of the petition and notify the relevant parties to make representation on that date.
  • 3: After hearing the parties, the court will set the date for recording the evidence and, for this purpose, it will resolve the issue and issue orders for the granting of the succession certificate.
  • 4: Upon entry of the application in the petition, the applicant must provide a guarantee in the form of a surety in the amount that the court deems appropriate, to protect the right of any person who may be affected by the issuance, use or misuse of the certificate.
